Introduction

A license is required for businesses and trades that are regulated by by-laws made to regulate health and hygiene in the area. Issuing this license also sends a good message to your customers that your business or trade is a place where public health and hygiene are well maintained. If a license is required under any by-law to operate a business or trade, and a license is also required under the National Environment Act, the Environmental Protection License must be obtained before obtaining a trade license from the Pradeshiya Sabha.

Legal Authority

• By-laws made under Section 267 of the Municipal Council Ordinance / Section 153 of the Municipal Council Ordinance / Section 122 of the Pradeshiya Sabha Act No. 15 of 1987 or by-laws deemed to be made thereunder and accepted by the Council:
• Section 148A of the Municipal Council Ordinance / Section 128A of the Municipal Council Ordinance / Section 167 of the Pradeshiya Sabha Act;
• Section 247A of the Municipal Council Ordinance / Section 164 of the Municipal Council Ordinance / Section 149 of the Pradeshiya Sabha Act;
• Section 23C of the National Environment Act No. 47 of 1980, where the industry to which the trade license applies is an industry requiring an environmental protection license.

Qualifications

• Must be a trade or business that is required to obtain a license from the Council under the provisions of any by-law.
• In the case of an activity that requires an Environmental Protection License in accordance with the regulations made under the National Environment Act, a valid Environmental Protection License must be held. (Section 23C of the National Environment Act No. 47 of 1980)

• Application form in accordance with the format in Annexure No. 01 hereto;
• In the case of an activity that requires an Environmental Protection License in accordance with the regulations made under the National Environment Act, a valid Environmental Protection License.
